Does a construction employee have any rights if they are unjustly dissmissed

Generally, construction employees are not entitled to termination pay or severance pay under the Ontario Employment Standards Act. That said, construction employees are potentially entitled to common law notice of termination or pay in lieu thereof.
Whether or not a construction employee is entitled to notice/pay in lieu of notice will greatly depend on:
1) whether or not the individual signed a contract of employment
2) if so, whether there is language that effectively ousts the employee's right to common law notice
3) other factors specific to the employee, i.e. whether the employee has been temporarily laid off in the past, etc.
