Because of harassment from my boss I will quit my job soon. I was told if I get fired, do not sign any document-take it to a lawyer first. 2 questions:
1. if I quit and provide a letter of resignation, is there anything that I should not sign...I ask because I understand this situation is called a 'constructive dismissal' so I don't want to limit any settlement I can get.
2. though I quit, can I apply for EI - my research into EI lists various reasons for 'voluntary Leaving Employment' in section 6 of the Digest of benefit Entitlement Principles.
3. How do you charge for your services - hr fee or % of overall settlement
NB: I have been w/ this employer for 15 months, full benefits, $48K/annual
Thanks,
Shelly

Thanks for your question. Before you quit or resign it is extremely important that you call us first and book an appointment to discuss your situation with one of our employment lawyers. Constructive dismissal is not guaranteed and requires deeper analysis. We would certainly want to know more about the harassment issues in your workplace and provide further guidance. During a consultation with one of our employment lawyers we will be able to address all your questions in greater detail. Please do not hesitate to give us a call and set up a time to talk.

Also, I would also suggest that you visit the severance pay calculator our firm has developed to see what you may be owed (www.SeverancePayCalculator.com).
