My son (18) was fired abruptly yesterday for taking a break and eating before his shift got busy. The rule was not to eat between 6-9pm and it was prior to this time. He received no prior warning (verbal or written) and the owner cursed and yelled at him and told him to leave.

Thank you for contacting our firm.

Employers face a high bar in alleging termination for cause. As such, it is unlikely your son's conduct would merit such a drastic response.

Your son may be entitled to damages for wrongful dismissal. However, the extent of those damage will depend on a variety of factors. We would need more information before providing a further assessment.
