I worked for a company for 1 years and 5 months as Order Fullfillment Specialist. In the pass, They removed me from full-time Order Fulfillment Specialist to 50% of order processing and 50% Misc. such as answering the phone, greeting Client, sending sample, etc. However, we got busy again, and was back as full-time Order Fullfillment Specialist for awhaile. However, I am told that company Is being restructuring again. This time, I think they are going re-do my job description and probably get me to sign it? I told them that I was hired as full time Order Desk and I like to keep it that way. I said I do not like doing the Misc. task. Do I have a choice? Can I refuse to do the misc. tasks? I saw the web that they are hiring Order Fullfillment Specialist again. I feel like they are demoting me or a way to force me resign. Please advise

If this is a true demotion, in the sense that you are performing a job with less responsibility, less prestige, and at a lower level, then it could form the basis of a constructive dismissal. In that case, you will have a choice to stay and accept the change or leave and claim constructive dismissal. However, it is important not to make any decisions before meeting with an employment lawyer. If you leave and it is not a constructive dismissal, you will be giving up your severance.
