I’m on WSIB and currently in therapy. Return to work offered but hours are not suitable as I can not do my regular job. I worked mon to thurs only for 11 years. Now they want me to wrk alternating weekends and different shift hours. Do I have to take it

Thank you for your question. My name is Jon Pinkus and I am an employment lawyer with Samfiru Tumarkin LLP.

You may have to take it, if it is the only position that the company has available. The question here is whether the company can establish undue hardship in accommodating your disability. If they have an alternative role for you and refused to offer it, it could be a human rights violation and a breach of the terms of your employment.

I would recommend that you contact us at the number below as soon as possible for a consultation, so that we can discuss whether the company truly has met their obligation of accommodating you up to the point of undue hardship.
