What are legitimate reasons to terminate with cause? My husbands employer and union rep have advised that they are planning to dismiss him after he has not returned to work from a medical stress leave, the last communication to them was March 8 where he advised he would be seeing his doctor again. They are citing his CBA states that they can terminate him after 3 days, understood, is this legitimate cause?

An employer cannot terminate an employee's employment due to a medical disability or the need for a medical leave of absence. The collective agreement should not allow for this, as it constitutes a violation of human rights legislation. I recommend your husband seeks further clarification from his union representative on this issue.
