Can an employer fire you for being off work with an injury?

Thanks for your question. An employer cannot terminate employment due to a medical leave. This is against the law and a breach of the Ontario Human Rights Code. If your employment has been terminated because you are on medical leave, you would be owed severance pay and human rights damages. If this is the case, you should call us immediately at the number below in order to speak to a lawyer about your legal entitlements. We would be pleased to assist you in any way that we can.
