Add Comment Question: My son is a Laborer and is in the Union , he was fired last week while he was on light duties because he hurt his back @ work. The reason on his papers stated the following : Unconditional Break, however , since this has happened he has talked to his Union Rep and the Union has now come back and said they will provide my son with an ROE stating - Shortage of Work and also said they would compensate him with 6 weeks of pay. My son has worked at this company for 3 years, is this sufficient amount of severance ? Answer: As a member of the union, your son cannot sue in civil court for and only the union can represent him against his employer with respect to severance. However, if your son's termination was related to his medical condition/light duties, then this may constitute a violation of his human rights and they may not be allowed to terminate him whatsoever.
