Add Comment Question: I received a letter of termination in the mail while I'm off on sick leave with no explanation as to why, can they so such a thing? Answer: Generally an employer can terminate an employee at any time, on a without cause basis, such that you are paid your termination entitlements. However, if you are on a medical leave from work, they have a duty to reinstate you to your position or to a comparable position, unless your position has been validly eliminated. As such, if terminated while on a sick leave, not only would you be owed your termination entitlements, you are likely also owed Human Rights damages as a result of the employer's breach of the Ontario Human Rights Code. You should definitely contact the number below to speak with one of our employment lawyers so we can better assess your entitlements.
