Add Comment Question: I told my boss that I didn’t want to work late since I was given zero notice on a last minute job on a Friday after he tried to force me to work overtime for the Nth time. I ended up simply leaving at my normal time cause he wasn’t at the shop when I left but he saw me driving away and followed me tailgating me until I pulled over and told him that I have things to do at which point he replied with “you like your job” in a angry way then sped off. At the moment he hasn’t said anything about me being fired but I want to be prepared if he does so what should I do? Answer: Thanks for your question. The Ontario Employment Standards Act provides protection for employees against being forced to work overtime hours. You are entitled to refuse to work overtime hours and your employer cannot penalize you in any way, including the termination of your employment. If your employer is harassing you regarding your refusal to work overtime hours or if your employer terminates your employment for refusing overtime hours, it could be liable for a significant financial penalty that can be imposed by the Ministry of Labour, and you would be entitled to notice of your termination or payment in lieu thereof. To find out how much severance pay you could be owed if your employment is terminated, use our Ontario Severance Pay Calculator (linked at the top of this page).
