Add Comment Question: I was Terminated about 10 min ago over the phone. I haven't worked since Tuesday cause Wed I called in sick, wed evening I received a text saying Don't come in tomorrow and I received the same text thurs. evening. I texted back and asked what was going on, no reply! Om Friday I texted back and asked what was going on, she said she was in meetings and needed to talk in person. I replied "Great I know what that means" she never got back to me till noon today then I called her back at 815pm. She said sorry but there was nothing she could do her hands were tied, she said I spent that I took the company credit card and spent 3.50 and 26.00 at Macs Milk. I didn't take the card it was giving to me by a owner to get 4 cans of spray paint. I got the spray paint then went to burger king and at burger king I grabed the wrong card, meaning there's not mine and tapped it, too late! I thought it is just 3.50 so I can give them money or whatever and fix this problem. when I got back gave the card back and reciept to the owner. it was busy and I forgot to mention something. Tuesday night they came and asked and and I said oh my god I forgot all about that. I made a mistake and accidentlly used your card for 3.50, but had no idea about the other charge, then the above happened, at the start of my story!! what is going to happen with me? Answer: The first thing to consider is whether you were terminated without cause, and provided with notice, or in your case, pay in lieu of notice, or whether the company has alleged it had just cause to terminate your employment. That is a difficult threshold for companies to make, particularly if this is the first time any such error has occurred, and the error was accidental. If you have been provided with pay in lieu of notice for a without cause termination, we can help you evaluate whether the termination pay provided is sufficient and meets the company's obligations. If you were terminated for just cause, we can also assist you. It would be helpful to contact the employer and request a letter of termination so that you can see what their position is, unless she mentioned that over the phone. In any event, we suggest you call our office to set up a consultation with one of our lawyers, who would be happy to assist you with your case.
