Add Comment Question: I was let go from my job after returning from an illness. They said they hired a third party company to do the work which is more cost effective for them. Is this legal? Answer: Generally an employer has the ability to terminate you at any time, without even having to provide a reason why, as long as you are terminated on a 'without cause' basis and paid your severance entitlements. It is not illegal per se for the company to terminate you for business reasons (i.e. to source out the work to a third party). However, if it can be shown that even 1% of the reason you were terminated was due to your recent medical leave not only would you be entitled to severance, but you may be owed additional damages under the Ontario Human Rights Code due to discrimination in your employment. I highly recommend that you contact the number below so speak further about your case with one of our employment lawyers so we can better assess your entitlements.
