Add Comment Question: My employer said I did something and when asked I said I didn’t and they have no proof that I did what they said I did can they fire me for this? Answer: An employer has the ability to terminate you at any time on a 'without cause' basis (without even having to provide a reason why), such that they would have to pay you your termination/severance entitlements. However, in some incidents an employer may try to allege 'just cause' dismissal for termination (i.e. for misconduct, poor performance, breach of a policy, etc.), such that they take the position they do not have to pay you anything. It is very difficult for an employer to prove just cause for termination, but it ultimately depends on the specific facts of the case. If you are terminated from your employment, either on a without cause or just cause basis, you should contact our firm so one of our employment lawyers can more thoroughly asses your matter and determine your termination entitlements.
