Add Comment Question: I had a workplace injury on my right knee that has required two surgery’s. On the day that a return to work meeting with employer and wsib was scheduled my employer called me to cancel meeting and proceeded to say that I was terminated. Once wsib found out they contacted my employer and educated them on the consequences in doing this. Now the employer does not want to terminate and has offered a job that is a demotion and a 40 percent decrease in pay. Wsib wants me to take the position. I do not plan on returning to an employer that terminated over the phone nor would I accept this demotion. In need of advice on what to do. Answer: My name is David Vaughan and I'm an employment lawyer with Samfiru Tumarkin. Your employer's actions appear to contravene human rights legislation. Further, you generally don't have an obligation to accept a demotion and pay cut. However, before doing anything about this, please contact our firm to discuss the matter in more detail and determine how we can assist you.
