I was a 13 year employee , terminated at was to be my workplace accommodation meeting after being on LTD for 1.5 years. “Non Culpable Frustration of Employment Contract”. Is this legal? The LTD ins. Company is also shocked as we have been working very hard to get me well.

Hello,

My name is Andrew Goldberg, an Employment Lawyer at Samfiru Tumarkin LLP, and I am very sorry to hear about your unfortunate situation.

In order for your former employer to rely on "frustration of contract" to terminate your employment, they must prove there is no reasonable likelihood of you returning to work within a reasonable period of time. Considering you have been working hard with your insurance company to get you back to work, it is likely that the termination of your employment is a wrongful dismissal.

To discuss your situation and potential entitlements, I would recommend emailing me directly at andrew.goldberg@stlawyers.ca and we can set up a consultation.

Regards,

Andrew
