I was fired by my employer for insubordination while under a Return To Program with WSIB and the company is now withholding my severance pay as a blackmail act because I refuse to sign a document that exempts them from any responsibilities for my injury and also against any legal action on my behalf. I would like to know if the company can legally deny and hold an employees severance as a bargaining tool?

Thank you for your question. In most cases, an employer will ask an employee to sign a Release in exchange for a severance package. However, it is extremely important that you review their severance offer with one of our lawyers, and discuss your situation in more detail. Your employer's offer could potentially be significantly less than your legal entitlements, and the company may have breached their obligations under WSIB. Please give us a call at the number below as soon as possible. The initial call to us is free, and we would be happy to help in any way we can.
