Good morning,
I was offered a three month contract, which was signed by both me and my employer. A few weeks later she changed the working hours taking me off schedule completely because a foster dog ran out of the foster home (I run a dog rescue in my spare time which has nothing to do with the employment) and I was organizing a search etc. I did not take the employers advice when she offered telling her I’d rather keep that separate from work. She told me she changed the hours because my efforts should be spent on looking for the dog, even though I told her a few times that I didn’t need any time off for that, and I would handle that in my spare time.
She did give my hours to the foster mother of the dog, whose house the dog ran out of.
Not only she discriminated against me for looking for a lost dog, thus taking me off schedule, but at the end, she took away all the hours I was supposed to work and the last email she sent ended in ‘Good Luck in your future’.
I had worked there for only 2 months or so, first on a 30 day contract, and was offered a 90 day contract, out of which only about a month was fulfilled.
I was told what days and hours to come to work for and was being paid hourly rate.
I would appreaciate your thoughts on the matter. Thank you in advance
If your employer changed the terms and conditions of your employment without your consent this could amount to a constructive dismissal of your employment entitling you to severance. However, it seems the employer may have acknowledged that they did in fact terminate you, which is helpful. In any event, you could have an argument to make that you should be entitled to the balance of your contract (i.e. the pay you would have received had you continued working for the employer to the end of the contract).
