I went home from work due to duress. Employer was going against accommodation in place. I did vent with Costaff on the way out but never told management that I quite.
When I went in on Monday I was told they couldn’t give me my job back because it would set a bad precedence.
The issue is that my ex employer assumed I was quitting but I was not and I feel that severance pay should have been give to me.
I feel they may have taken my venting with a costaff as my quitting but I was just going home. Again, I did not say/write anything to manage to that I quite.
I need some insight and advice
We need more information about the accommodation plan you were on and the communication with the employer before you left the workplace. A resignation must be clear and unequivocal so you are correct that they could not "assume" that you resigned and they may owe you termination pay and additional damages for failure to accommodate.
