I was terminated I was the health and safety rep and they terminated me for letting employees know about a safety concern that I had They did not offer me a severance package. Do they have the right to terminate me when it’s a health concern regarding our health and safety?

My name is Andrew Goldberg, and I am an Employment Lawyer with Samfiru Tumarkin LLP.

Based on your description above, the company has no basis to legally withhold your severance entitlements, as it is clear that you were terminated without cause.

Furthermore, if the Ontario Labour Relations Board (OLRB) finds that your employment was indeed terminated because you expressed your safety concerns to colleagues, this could amount to a "reprisal" under the Ontario Occupational Health and Safety Act. In turn, the OLRB may award your reinstatement with back-pay from the date of termination. However, I would need further information from you to adequately assess the merits of your case.

Please visit https://www.severancepaycalculator.com/ to determine your entitlements and contact me at andrew.goldberg@stlawyers.ca to discuss your matter further. It would be my pleasure to speak with you.
